1. ACCEPTANCE OF TERMS
By using Bluepix services, sending images via WhatsApp, or purchasing credits, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
Bluepix is operated by Bluesquare Group, incubated at Gnanamani College of Technology ("Company," "we," "us," or "our").
2. SERVICE DESCRIPTION
2.1 What We Provide
Bluepix is an AI-powered image enhancement service that:
- Transforms product photos into professional marketing images
- Operates through WhatsApp messaging platform
- Uses advanced artificial intelligence for image processing
- Delivers enhanced images instantly via WhatsApp
- Allows addition of text overlays (pricing, offers, contact information)
2.2 Service Availability
- Services are available 24/7 subject to maintenance and technical limitations
- We aim for 99% uptime but do not guarantee uninterrupted service
- Processing time is typically under 30 seconds but may vary based on system load
- Service is currently available in India with plans for international expansion
3. USER ACCOUNTS AND REGISTRATION
3.1 Account Creation
- Accounts are created automatically when you first interact with our WhatsApp service
- Your WhatsApp phone number serves as your unique identifier
- You must provide accurate contact information
- One account per phone number is permitted
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account
- All activities that occur under your account
- Ensuring your phone number is secure and accessible
- Notifying us of any unauthorized use
4. CREDIT SYSTEM AND PRICING
4.1 Credit-Based System
- Services operate on a prepaid credit system
- One credit = one image enhancement
- Credits are non-transferable and non-refundable once purchased
- Unused credits expire after 12 months from purchase date
4.2 Pricing Plans
Current pricing (subject to change with notice):
- Free: 3 credits for new users
- Starter: Rs.299 for 10 credits (Rs.29.90 per image)
- Business: Rs.599 for 25 credits (Rs.23.96 per image)
- Growth: Rs.1,099 for 50 credits (Rs.21.98 per image)
- Agency: Rs.1,999 for 100 credits (Rs.19.99 per image)
4.3 Payment Terms
- Payments processed securely through Razorpay
- All prices include applicable taxes
- Payment must be completed before credits are added to your account
- We reserve the right to modify pricing with 30 days notice
5. ACCEPTABLE USE POLICY
5.1 Permitted Use
You may use Bluepix to enhance:
- Product photographs for legitimate business purposes
- Personal items for commercial or non-commercial use
- Marketing materials and advertisements
- E-commerce listings and social media content
5.2 Prohibited Content
You may NOT submit images containing:
- Inappropriate, offensive, or adult content
- Copyrighted material you don't own rights to
- Personal photos of individuals without consent
- Illegal items or activities
- Violence, hate speech, or discriminatory content
- Medical or pharmaceutical products requiring special licenses
5.3 Consequences of Violation
Violation may result in:
- Immediate service suspension
- Account termination without refund
- Legal action if applicable
- Reporting to relevant authorities
6. INTELLECTUAL PROPERTY RIGHTS
6.1 Your Content
- You retain all rights to your original images
- You grant us a limited license to process and enhance your images
- You warrant that you own or have permission to use submitted images
- You are responsible for any copyright infringement claims
6.2 Enhanced Images
- Enhanced images are provided for your use and commercial purposes
- We may retain anonymized copies for service improvement
- You receive full commercial usage rights to enhanced images
- We reserve the right to use enhanced images for marketing (with consent)
6.3 Our Technology
- Bluepix technology, algorithms, and processes are our proprietary assets
- You may not reverse engineer, copy, or replicate our services
- All trademarks and service marks belong to their respective owners
7. AI-GENERATED CONTENT DISCLAIMER
7.1 AI Technology Limitations
- Enhancements are generated using artificial intelligence
- Results may vary based on image quality and content
- We do not guarantee specific enhancement outcomes
- AI processing may occasionally produce unexpected results
7.2 Quality Expectations
- We strive for high-quality enhancements but cannot guarantee perfection
- Some images may not be suitable for AI enhancement
- Complex or low-quality images may have limited improvement potential
- User satisfaction may vary based on individual expectations
7.3 No Warranty on Results
- Enhanced images are provided "as is"
- We do not warrant commercial success from using enhanced images
- Results depend on many factors beyond our control
8. DATA PROTECTION AND PRIVACY
8.1 Data Collection
We collect:
- WhatsApp phone numbers and profile information
- Images submitted for enhancement
- Payment information through Razorpay
- Usage analytics and service performance data
8.2 Data Usage
Your data is used to:
- Process and enhance your images
- Provide customer support
- Improve our AI algorithms
- Send service-related communications
- Comply with legal requirements
8.3 Data Storage and Security
- Images are stored securely during processing
- Original images are deleted within 30 days
- Enhanced images may be retained for your access
- We use industry-standard security measures
- Data is stored within India unless specified otherwise
8.4 Your Rights
You have the right to:
- Access your personal data
- Request data correction or deletion
- Withdraw consent for data processing
- Export your data in portable format
- File complaints with data protection authorities
9. WHATSAPP INTEGRATION
9.1 Third-Party Platform
- Our service integrates with WhatsApp Business API
- WhatsApp's terms and policies also apply to your interactions
- We are not responsible for WhatsApp service interruptions
- Message delivery depends on WhatsApp's infrastructure
9.2 Communication Consent
By using our service, you consent to:
- Receiving automated messages via WhatsApp
- Service notifications and updates
- Marketing communications (opt-out available)
- Customer support interactions
10. LIMITATION OF LIABILITY
10.1 Service Limitations
We are not liable for:

- Indirect, incidental, or consequential damages
10.2 Maximum Liability
Our total liability is limited to:
- The amount you paid for credits in the last 12 months
- Direct damages only (no indirect or consequential damages)
10.3 User Responsibilities
You agree to:
- Use the service at your own risk
- Maintain appropriate backups of original images
- Verify enhanced images before commercial use
- Indemnify us against claims arising from your use
11. REFUND AND CANCELLATION POLICY
11.1 No Refunds
- All credit purchases are final and non-refundable
- Used credits cannot be refunded under any circumstances
- Unused credits may be refunded at our sole discretion
- Processing fees are non-refundable
11.2 Service Issues
If you experience service problems:
- Contact support within 48 hours
- We may provide replacement credits for technical failures
- Refunds considered only for platform-wide outages
- Alternative resolution may be offered instead of refunds
12. ACCOUNT TERMINATION
12.1 Termination by You
- You may stop using the service at any time
- Account deletion requests can be made via support
- Unused credits are forfeited upon voluntary termination
12.2 Termination by Us
We may suspend or terminate your account for:
- Violation of these Terms
- Inappropriate content submission
- Payment disputes or chargebacks
- Suspected fraudulent activity
- Extended inactivity (6+ months)
12.3 Effect of Termination
Upon termination:
- Access to services is immediately revoked
- Unused credits are forfeited
- Enhanced images may be deleted after 30 days
- These Terms survive termination where applicable
13. MODIFICATIONS TO TERMS
13.1 Updates
- We may update these Terms periodically
- Significant changes will be communicated via WhatsApp
- Continued use constitutes acceptance of updated Terms
- Current version will always be available on our website
13.2 Notification
Changes will be communicated through:
- WhatsApp message to active users
- Email notifications (if provided)
- Website posting
- In-service notifications
14. GOVERNING LAW AND JURISDICTION
14.1 Indian Law
- These Terms are governed by Indian law
- Disputes subject to jurisdiction of Tamil Nadu courts
- Indian Consumer Protection Act 2019 applies where applicable
- Information Technology Act 2000 compliance maintained
14.2 Dispute Resolution
- Good faith negotiation preferred for dispute resolution
- Mediation through recognized institutions if needed
- Arbitration in Chennai, Tamil Nadu if required
- Small claims court for amounts under Rs.20,000
15. MISCELLANEOUS
15.1 Entire Agreement
These Terms constitute the entire agreement between you and Bluepix regarding use of our services.
15.2 Severability
If any provision is found unenforceable, the remainder of the Terms remain in effect.
15.3 No Waiver
Failure to enforce any provision does not constitute a waiver of our rights.
15.4 Assignment
We may assign these Terms; you may not assign them without our consent.
